Passenger.ie is committed to complying with all applicable export control laws and regulations, including those of Ireland, the European Union, and the United States where applicable.
This Export Compliance Statement outlines our commitment to lawful distribution and use of our software application.
Scope of Service
Passenger.ie is a consumer-oriented mobile application designed for Irish Rail Free Travel Pass holders to book train tickets within Ireland. The app:
- Is primarily intended for use within Ireland
- Facilitates bookings on Irish Rail (Iarnród Éireann) services only
- Does not contain encryption technology subject to export restrictions
- Is not a dual-use item or military application
Territory Restrictions
At launch, Passenger.ie is available exclusively in Ireland. We do not currently offer our service in territories subject to comprehensive trade embargoes or sanctions by the European Union, United States, or United Nations, including but not limited to:
- Countries subject to EU sanctions
- Countries designated by the U.S. Office of Foreign Assets Control (OFAC)
- Regions under international trade restrictions
We reserve the right to restrict access to our service from any territory where we determine that providing the service would violate applicable law or regulations.
Encryption and Technology
Passenger.ie uses standard, publicly available encryption technologies solely for the purpose of protecting user data during transmission. These technologies include:
- HTTPS/TLS for secure data transmission
- Standard encryption libraries commonly used in web and mobile applications
These encryption implementations are widely available and do not constitute controlled cryptographic items under EU or Irish export regulations.
User Responsibilities
By using Passenger.ie, you represent and warrant that:
- You are not located in, under the control of, or a national or resident of any country subject to comprehensive trade embargoes
- You are not on any list of prohibited or restricted parties maintained by the EU, Ireland, or other applicable jurisdictions
- You will not use the app in violation of any export control laws or regulations
- You will not use the app for any purpose prohibited by Irish, EU, or international law
Prohibited Uses
You may not use Passenger.ie:
- In any manner that violates export control laws or regulations
- To export, re-export, or transfer the app or any technical data to prohibited territories
- For any military, nuclear, missile, chemical, or biological weapons purposes
- In support of activities that violate international human rights standards
Compliance Commitment
Passenger.ie is committed to:
- Monitoring changes to export control laws and regulations
- Implementing appropriate technological and administrative controls
- Cooperating with authorities on export compliance matters
- Updating this statement as needed to reflect regulatory changes
Distribution Channels
Passenger.ie is distributed through:
- Apple App Store: Subject to Apple's export compliance procedures and regional availability settings
- Web Application: Via passenger.ie with geographic access controls
These distribution platforms have their own export compliance mechanisms that complement our internal controls.
No Marketing or Tracking
Passenger.ie does not:
- Employ tracking technologies beyond essential service functionality
- Sell user data to third parties
- Use advertising networks
- Engage in data mining for commercial purposes
Our minimal data collection approach reduces potential export compliance concerns related to data transfers.
Violations and Enforcement
If we become aware of any use of Passenger.ie that violates export control laws or this compliance statement, we reserve the right to:
- Immediately suspend or terminate access to the service
- Report violations to appropriate authorities
- Cooperate fully with any investigations
- Take legal action to enforce compliance
