1. Acceptance of Terms
By downloading, installing, or using the Passenger.ie mobile application ("App," "Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and Passenger.ie regarding your use of the App.
2. Description of Service
Passenger.ie provides train ticket booking services through two platforms:
2.1 Mobile App (iPhone and Android)
The Passenger app is free to download on the Apple App Store and Google Play, and allows anyone to book train tickets. Features include:
- Paid tickets for all passengers
- Free tickets for Free Travel Pass holders
- Natural language booking interface
- Journey search and selection
- Automated booking assistance
- Ticket delivery via email
- Apple Wallet integration for ticket storage (iPhone)
Your first booking is free. After that, a once-off in-app purchase of €9.99 unlocks unlimited bookings — there is no subscription.
2.2 Website
The Passenger.ie website provides information about the service. Ticket booking is available exclusively through the Passenger mobile app.
3. Eligibility
The Passenger app is available to anyone who wishes to book train tickets. You must:
- Be at least 18 years of age
- Have the legal capacity to enter into these Terms
- Provide accurate and complete information when using the Service
A Free Travel Pass is not required to use the Service. However, to book free-travel tickets you must hold a valid Free Travel Pass issued by the Department of Social Protection.
4. Account and Registration
4.1 User Information
You agree to provide accurate, current, and complete information during the booking process. You are responsible for maintaining the confidentiality of your booking information and for all activities that occur using your information.
4.2 Free Travel Pass
The app is available to all users and does not require a Free Travel Pass. By booking a free-travel ticket, you confirm that you possess a valid Free Travel Pass and are entitled to its benefits.
5. Use of Service
5.1 Permitted Use
You may use Passenger.ie solely for:
- Booking train tickets for yourself (or a companion, where permitted)
- Accessing journey information for train services in Ireland
- Managing your bookings made through the App
5.2 Prohibited Use
You agree NOT to:
- Use the App for any unlawful purpose or in violation of these Terms
- Book tickets for commercial purposes or resale
- Book free-travel tickets without holding a valid Free Travel Pass
- Use automated systems or software to extract data from the App
- Interfere with or disrupt the Service or servers connected to the Service
- Attempt to gain unauthorized access to any portion of the App
- Impersonate any person or entity
- Use the App to transmit any malicious code or harmful content
6. Third-Party Services
6.1 Train Operator Services
Passenger.ie facilitates bookings through the train operator's (Iarnród Éireann) publicly accessible booking system. Your actual train travel is governed by the train operator's terms and conditions. We are not affiliated with, endorsed by, or sponsored by the train operator.
6.2 Disclaimer
- We do not guarantee the availability of trains or seats
- We are not responsible for changes to the train operator's schedules or services
- We are not liable for any issues with the train operator's booking system
- Train travel is subject to the train operator's terms, conditions, and policies
7. Booking and Cancellation
7.1 Booking Confirmation
Bookings are confirmed only when you receive a confirmation email with your ticket from the train operator. We are not responsible for failed bookings due to:
- Train operator system unavailability
- Sold out trains
- Technical issues beyond our control
7.2 Modifications and Cancellations
Any changes or cancellations to bookings must be made directly with the train operator according to their policies. The App does not currently support booking modifications or cancellations.
7.3 Accuracy of Information
You are responsible for ensuring all booking information is accurate, including:
- Passenger names matching your Free Travel Pass (for free-travel tickets)
- Correct travel dates and times
- Valid email address for ticket delivery
8. Fees and Payments
8.1 Mobile App
The Passenger app is free to download on the Apple App Store and Google Play. Your first booking is free. After that, a once-off in-app purchase of €9.99 unlocks unlimited bookings. This is not a subscription – you pay once. All purchases are processed through the Apple App Store or Google Play.
8.2 Website
The Passenger.ie website is informational only. All ticket bookings are made through the mobile app.
8.3 Travel Costs
Train ticket prices are set by the train operator. Free Travel Pass holders can book free tickets. All other passengers pay the train operator's standard fares. Any additional costs (such as seat reservations or upgrades) are subject to the train operator's pricing.
8.4 Refunds
All refund requests for in-app purchases must be processed through Apple or Google, depending on where you made the purchase. See our Refund Policy for details.
9. Intellectual Property
9.1 Ownership
All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Passenger.ie and are protected by international copyright, trademark, and other intellectual property laws.
9.2 License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
10. Privacy and Data Protection
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our collection and use of your information as described in the Privacy Policy.
11. Disclaimers and Limitations of Liability
11.1 "As Is" Basis
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.
11.2 No Guarantee
We do not guarantee that:
- The App will be uninterrupted, secure, or error-free
- Bookings will always be successful
- Information provided will be accurate or complete
- The App will meet your requirements
11.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PASSENGER.IE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Missed trains or connections
- Booking failures
- Loss of data
- Loss of profits or revenues
- Travel disruptions
11.4 Maximum Liability
Our total liability to you for any claims arising from or related to these Terms or your use of the App shall not exceed €100.
12. Indemnification
You agree to indemnify, defend, and hold harmless Passenger.ie, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising from:
- Your violation of these Terms
- Your misuse of the App
- Your violation of any third-party rights
- Any misrepresentation regarding your Free Travel Pass status
13. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by:
- Updating the "Last Updated" date
- Posting a notice in the App
- Sending an email notification (if applicable)
Your continued use of the App after such modifications constitutes acceptance of the updated Terms.
14. Termination
14.1 By You
You may stop using the App at any time by uninstalling it from your device.
14.2 By Us
We may suspend or terminate your access to the App immediately, without prior notice, if:
- You breach these Terms
- We are required to do so by law
- We discontinue the Service
14.3 Effect of Termination
Upon termination, all licenses and rights granted to you will immediately cease.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by the laws of Ireland, without regard to its conflict of law principles.
15.2 Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through:
- Good faith negotiations between the parties
- If negotiations fail, binding arbitration in Dublin, Ireland
- Small claims court for qualifying disputes
15.3 Jurisdiction
You consent to the exclusive jurisdiction of the courts of Ireland for any legal proceedings.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Passenger.ie regarding the App.
16.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
16.3 Waiver
No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term.
16.4 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent.
16.5 Force Majeure
We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control.

18. Special Provisions for App Stores
18.1 Apple App Store
If you download the App from the Apple App Store, you acknowledge that:
- These Terms are between you and Passenger.ie only, not Apple
- Apple has no obligation to provide maintenance or support for the App
- Apple is not responsible for any product warranties
- Apple is not responsible for addressing any claims relating to the App
- Apple is a third-party beneficiary of these Terms with the right to enforce them
18.2 Google Play
If you download the App from Google Play, you acknowledge that:
- These Terms are between you and Passenger.ie only, not Google
- Google has no obligation to provide maintenance or support for the App
- Google is not responsible for any product warranties
- Google is not responsible for addressing any claims relating to the App
By using Passenger.ie, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
